Terms and Conditions

1. Promotion and Promoter

These terms and conditions (Terms) are for the Promotion referred to as ‘Venergy Solar 2027 F1 Promotion’ (Promotion). 

The Promotion is run by the VENERGY PTY. LTD. ABN 88 139 522 213 (Promoter).

The Promoter will publish all information relating to the Promotion on its website at www.venergysolar.com.au (Website).

2. Eligibility

2.1.     Entry is open to Australian residents aged 18 years or over as at 1 June 2026 who reside in South Australia, Western Australia, New South Wales or Victoria and who enter into a Qualifying Contract (as defined in section 4) with the Promoter.

2.2.     Employees of the Promoter, its related entities, contractors associated with this promotion, and their immediate family members are ineligible.

3. Promotional Period

The promotion commences at 12:00am (ACST) on 1 June 2026 and closes at 11:59pm (ACST) on 31 December 2026 (Promotional Period).

4. Qualifying Criteria

4.1.     To be eligible for entry into the Promotion, a customer of the Promoter must:

(a)   enter into a contract with the Promoter from 1 June 2026 until the end of the Promotional Period for the purchase and installation of a new Sungrow Solar System along with an eligible Sungrow product (being a Sungrow inverter, battery, and/or EV charger) at a residential property in South Australia, Western Australia, New South Wales or Victoria (Qualifying Contract);

(b)   ensure full payment of all invoices relating to the Qualifying Contract are received by the Promoter in clear funds during the Promotional Period; and

(c)    leave one (1) Google review or/and one (1) SolarQuote review for Venergy Solar during the Promotional Period that meets the criteria in 4.3 below,

(the Qualifying Criteria).

4.2.     For the avoidance of doubt, a Qualifying Contract does not include a contract that relates only to servicing, upgrades or maintenance.

4.3.     The online review(s) must be genuine, relate to the Sungrow system and products purchased under the Qualifying Contract, and reflect the customer’s honest opinion of the relevant Product. Providing a negative review will not affect a customer’s chance to win the Prize (as defined below).

5. Entry

5.1.     A customer is automatically entered into the Promotion once they satisfy the Qualifying Criteria (Entrant).

5.2.     Each Entrant is assigned a number of entries into the Promotion (Entry) that correlates with the purchases made under the Qualifying Contract, so that where the Qualifying Contract includes the purchase of a Sungrow Solar System and:

  • Sungrow inverter, the Entrant is awarded 1 entry; or

  • Sungrow inverter and Sungrow battery, the Entrant is awarded 2 entries; or

  • Sungrow inverter and Sungrow battery and Sungrow EV charger, the Entrant is awarded 3 entries.

5.3.     The number of Entries calculated under section 5.2 above is based on the Qualifying Contract, subject to any changes made on installation.

5.4.     Entrants can receive Entries for multiple Qualifying Contracts, provided the Qualifying Criteria are met for each and installation under each Qualifying Contract is at a different residential address.

5.5.      (Optional Bonus Entry) If a customer refers a friend to us during the Promotional Period, and that friend also meets the Qualifying Criteria and becomes an Entrant, then:

  • (a) the referring customer will receive one (1) additional Entry; and

  • (b) the referred friend will receive one (1) additional Entry.

5.6.     No fee is charged by the Promoter to enter the Promotion (but the costs associated with meeting the Qualifying Criteria are the sole responsibility of each customer).

5.7.     Once an Entry is submitted, the entry remains valid unless an exclusion in section 6 applies, and the Entrant acknowledges that the Entry may not otherwise be withdrawn, altered or deleted (except as and where required by the Promoter).

 6. Exclusions

An Entry will cease to be a valid Entry if the Qualifying Contract is cancelled, refunded and/or is deemed (by the Promoter, acting reasonably) to be void.  

7. Draw & Winner Selection

7.1.  The promotion will be drawn at 12pm (ACST) on 15 January 2027 at Promoter’s office, 15A Adam Street, Hindmarsh SA 5007 (Draw Date).

7.2.  The winning Entry will be drawn electronically by way of a random number generator that draws a winner at random.

7.3.  The Entrant of that winning Entry (Winner) will win the prize described in section 8 (Prize).

7.4.  The Winner will be notified by email and phone and their details (initial of first name, their surname and postcode) published on the Website within two (2) business days of the Draw Date.

7.5.  The Winner’s name may be published on the Promoter’s social media accounts.

7.6.  If the Promoter becomes aware that the Winner has not complied with these Terms, that Entrant will have no entitlement to the Prize, even if the Promoter has announced them as a Winner and that Entrant will be required, at the direction of the Promoter, to return, refund or otherwise make restitution of the prize.

7.7.  If a prize is not claimed within 14 days of the Draw Date then the prize will be redrawn on 5 February 2027. All Entries of the Winner from the first draw are not eligible for this second prize draw. This second draw will take place at 12pm (ACST) on 5 February 2027 at Venergy Solar, 15A Adam Street, Hindmarsh SA 5007. The Winner will be notified by email and phone and their details (initial of first name, their surname and postcode) published on the Website within two (2) business days of the draw, and the Winner’s name may be published on the Promoter’s social media accounts.

7.8.   

7.9.  If this Promotion cannot run as planned for any reason, whether caused by computer virus, mobile phone failure, line drop out, bugs, tampering, unauthorised intervention, fraud, technical failures or any other cause beyond the reasonable control of the Promoter which corrupt or affect the administration, security, fairness or integrity of the Promotion, the Promoter may (subject to any written direction given by a relevant regulatory authority), cancel, terminate, modify or suspend the Promotion. The Promoter is not responsible for any problems or technical malfunction of any telephone, telephone or computer network, or lines, servers, or telephone or internet providers, traffic congestion on any phone or computer network, or any combination thereof, related to participation or sending or receiving of any communication or of any materials in this Promotion.

8. Prize

8.1.     The total prize pool is valued up to AUD $7,000 (incl. GST).

8.2.     The prize includes:

  • (a) two (2) economy flights departing from the Winner’s nearest capital city (being either Adelaide, Perth, Sydney or Melboure) (Home City) to Hefei, Peoples Republic of China (China);

  • (b) a hosted visit to the Sungrow’s manufacturing facility in Hefei, China;

  • (c) two tickets on high-speed rail travel from Hefei to Shanghai, China;

  • (d) four (4) nights’ accommodation (twin share) spread between InterContinental Hefei, China and The Westin Shanghai, China (or other similar hotel(s) selected by the Promoter);

  • (e) two (2) racing day tickets to the 2027 Formula 1 Grand Prix held in Shanghai, China (dates not yet announced); and

  • (f) two (2) economy flights departing Shanghai, China back to the Winner’s Home City,

(together, the Prize).

8.3.     The Winner must participate in Sungrow’s manufacturing facility visit as part of the Prize.

8.4.     The Prize is not transferable or redeemable for cash. In addition, the tickets provided as part of the Prize are not transferable and cannot be redeemed or converted to cash, nor can they be replaced if lost, stolen or defaced. Tickets can only be used on the date(s) specified on the ticket.

8.5.     If the Prize or any component of the Prize becomes unavailable, the Promoter may substitute it with an alternative of equal or greater value and specification, subject to any written directions from a regulatory authority.

8.6.     Travel dates will align with the above schedule and correspond with the dates of the 2027 Formula 1 Grand Prix held in Shanghai, China (dates not yet announced), with flights, train rides and accommodation to be selected by the Promoter at its sole discretion.

8.7.     The prize does not include the following, each of which must be covered and arranged by the Winner:

  • (a) travel costs between the Winner’s home and the Home City airport;

  • (b) passport costs and arrangements;

  • (c) insurance (such as travel insurance) costs and arrangements;

  • (d) vaccinations;

  • (e) health and medical expenses;

  • (f) meals (unless stated);

  • (g) visa costs and arrangements;

  • (h) spending money;

  • (i) personal expenses such as breakfast, meals, in-room dining, and other in-room charges; or

  • (j) any other costs not specifically stated in section 2 above.

8.8.     The Winner is solely responsible for meeting all passport, visa, health, character and employment requirements set by Australian, Chinese and other offshore authorities and relevant employers. The Promoter is not liable for visa refusal, cancellation, employment termination, or failure to meet government requirements (including to depart or enter any country) or employer requirements.

8.9.     The terms and conditions of third parties (such as airlines, train ride providers, accommodation providers and other service providers) may apply to any bookings made as part of the Prize. These terms may include, but are not limited to, cancellation policies and fees. The Promoter may not be a party to those bookings and assumes no liability for any losses to the Winner incurred under or in connection with those bookings.

8.10.   Without limiting section 10, the Promoter is not liable if the Winner fails to meet the terms and conditions of those third parties (for example, if the Winner misses or is refused boarding to a flight), in which case the Winner is solely responsible for all additional costs and arrangements necessary to enable the Winner to redeem the balance of the Prize.

8.11.   The Promoter accepts no responsibility for any tax implications of accepting or redeeming the Prize, or otherwise relating to the Prize.

8.12.   The Promoter may, in its sole discretion, request that the Winner (and its nominee under section 7.8) be required to sign a legal release prior to receipt of a Prize.

9. Tampering

The Promoter may disqualify any individual for tampering with the entry process. Tampering includes but is not limited to the utilisation of techniques designed to avoid payment or the making of multiple entries that are not associated with a separate eligible entry, or submitting an entry which is not otherwise in accordance with these Terms. Should the Promoter find evidence of tampering by an individual, in addition to declaring any or all entries made by that individual invalid, the Promoter may also preclude that entrant from participation in future promotions of the Promoter.

10. Liability

10.1.   The Promoter excludes, to the extent permitted by law, all conditions, warranties, guarantees, rights, remedies, liabilities and other terms implied by statute, custom or the common law are excluded from these Terms. If a supply under this agreement is a supply of goods or services to a consumer within the meaning of the Australian Consumer Law set out in the Competition and Consumer Act 2010 (Cth), nothing contained in this agreement excludes, restricts or modifies the application of any provision, the exercise of any right or remedy, or the imposition of any liability under the Australian Consumer Law, provided that, to the extent that the Australian Consumer Law permits the Promoter to limit its liability, then the Promoter’s liability will be limited to:

(i)      in the case of services, the cost of supplying the services again or payment of the cost of having the services supplied again; and

(ii)      in the case of goods, the cost of replacing the goods, supply equivalent goods or having the good repaired, or payment of the cost of replacing the goods, supplying equivalent goods or having the goods repaired.

  • Except as set out in section 1 above, the Promoter (including its officers, employees and agents) excludes all liability whether arising in tort (including without limitation negligence), contract or otherwise, for any personal injury, illness, death or any other loss or damage (including without limitation loss of opportunity or loss of profits), whether direct, consequential, special, incidental or indirect loss or damage including loss of profit or loss of opportunity, arising in any way out of the Promotion, including, without limitation, the following: (a) the Prize or any aspect of the Prize; (b) the Winner (and its nominees’) redemption or participation in the Prize or any aspect of the Prize (whether or not under the Promoter’s control); (d) the acts or omission of any third party supplier of the Prize or any aspect of the Prize; (e) any theft, unauthorised access or third party interference; (f) any entry or claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (g) any variation in Prize value to that stated in these Terms; and/or (h) any tax implications, including any tax liability incurred by a successful claimant or Entrant.

  • For the avoidance of doubt Formula One World Championship Limited (and its related companies) and the entity running the 2027 F1 event in Shanghai, China are not responsible for or involved in the design, running, draw or results of this Promotion

11. Privacy

All personal information collected by the Promoter in connection with this Promotion will be handled in accordance with the Promoter’s Privacy Policy on the Website. In addition, the Promotor may disclose and share personal information about the winner (and its guest) with each company involved in the delivery and redemption of the Prize.

The Promoter collects personal information of all customers who enter the Promotion (and any third party nominated by the Winner under section 7.8 above) in order to conduct the Promotion and may, for this purpose, disclose such information to third parties, including, but not limited to, prize suppliers and for any purpose required under Australian lottery legislation or any other regulatory authority. Recipients of Entrants’ personal information may be located in China and [anywhere else?]. Entry is conditional on providing this information. Unless otherwise advised at the time of entry, the Promoter may also use the information for promotional, marketing and publicity purposes as outlined in section 12 below. 

The Promoter’s privacy policy contains information about how an Entrant may access or correct personal information held about them or complain about a breach of the Australian Privacy Principles.  All entries become the property of the Promoter. 12. Publicity

By accepting the Prize, the Winner agrees to participate in follow-up interviews and publicity in relation to the Promotion and Prize, and the Promoter may use their name, image, photograph/s, film and sound recordings for publicity and promotion purposes, without compensation, and the Promoter will own copyright in any such images, photograph/s, film and sound recordings and in all material incorporating the same.  The third party nominated by the Winner under section 7.8 may also be requested by the Promoter to provide a similar acknowledgement and consent, as a condition of participating in the Prize.

13. Other

These Terms are governed by and construed in accordance with the laws of South Australia and the parties submit to the exclusive jurisdiction of South Australia.
